JimoBoto provides AI-powered marketing automation, proprietary workflow systems, campaign tools, subscription services, and related solutions.

3. User Responsibilities and Prohibited Conduct

You agree not to engage in unlawful, fraudulent, or harmful activities, including spam or unauthorized access. You are responsible for ensuring all content you create or send complies with applicable laws, including SMS regulations.

4. SMS Messaging Program and Messaging Use Cases

By providing your phone number and opting in, you consent to receive SMS messages from Painted Bear Enterprises LLC (d/b/a JimoBoto).

These messages may include:

Marketing and promotional messages

Service notifications and updates

Appointment reminders

Customer support responses

AI-generated content delivery and campaign alerts

Message frequency may vary. You can opt out at any time (see Section 5).

5. Instructions to Opt-Out (“Text STOP”)

You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us.

After opting out, you will no longer receive SMS messages unless you re-opt in. We will process your opt-out request promptly.

Message and data rates may apply. Rates are determined by your mobile carrier and plan. Contact your carrier for details.

8. Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages.

9. Intellectual Property Ownership and License

9.1 Ownership All right, title, and interest in the Services, including all software, AI models, proprietary prompts, workflows, templates, algorithms, interfaces, designs, and branding (“Company IP”), are and shall remain the exclusive property of Painted Bear Enterprises LLC.

9.2 Limited License We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Services solely for your internal business purposes during your active subscription.

9.3 Prohibited Uses You shall not (and shall not allow others to):

Copy, reproduce, distribute, sell, resell, sublicense, or commercially exploit any Company IP.

Reverse engineer, decompile, extract, modify, or create derivative works from workflows or prompts.

Use the Services to build a competing product.

Remove proprietary notices.

Share access beyond your licensed entity.

Export core workflows for use outside the platform.

9.4 Feedback

Any suggestions or feedback you provide become our sole property.

10. User Content

You retain ownership of your content but grant us a license to use it to provide and improve the Services.

11. Payments and Subscriptions

Subscriptions auto-renew. Fees are non-refundable except as stated in our Refund Policy.

12. Termination and Suspension

We may suspend or terminate access for violations of these Terms or non-payment.

13. Disclaimers and Limitation of Liability

The Services are provided “AS IS.” Our total liability shall not exceed the amount you paid in the prior six (6) months.

14. Indemnification

You agree to indemnify the Company from claims arising from your use of the Services.

15. Governing Law

Governed by Florida law. Disputes resolved by binding arbitration in Pinellas County, Florida.

16. Changes to Terms and Privacy Policy

We may update these Terms. Continued use constitutes acceptance. Your use is also governed by our Privacy Policy.
